Consommateurs & Marketing & Protection...

Vote on the implementation of the Unfair Commercial Practices Directive

The Committee adopted the amendments to this Directive with 32 votes in favour, 0 against and 0 abstentions. The amendments seek to ensure that consumers are not misled or exposed to aggressive marketing, thus enabling them to make informed and meaningful choices. Following the expiry of the transposition deadline (12 December 2007), previous Parliament resolutions on that matter, and two Commission documents (Report and Communication) published in March 2013, this report makes a broad assessment of the state of UCPD implementation.

The final report calls on the Member States to fully implement the Directive and apply the rules properly in order to protect consumers from misleading advertising or aggressive marketing. The Committee insisted inter alia that adequate penalties should be imposed on companies, that dialogue between authorities and consumer associations is held, that surveillance actions of the Commission ('sweeps') should be strengthened, and that the guidance document is updated regularly in order to reflect new practices appearing on the market.
