The “peace versus justice” debate is one of the central controversies in the application of international criminal law. The “justice” side of this debate uses fundamentally deontological reasoning to argue that pursuit of justice (human rights) is a social good in and of itself. Thus, the pursuit of justice cannot be held to be subordinate to any other concern, such as the achievement of sustainable peace. In contrast, the “peace” side of the debate contends that considerations of conflict resolution should be prioritised and that sometimes justice will need to be sacrificed, or put aside, in order to achieve the greater social good of peace. Neither side believes that either peace or justice is unimportant, rather the controversy is really a question of priority and strategy.

This debate has many practical implications, not the least of which are decisions about when to pursue prosecutions for international crimes. The proponents of the “peace” side of the peace-justice debate argue that in some cases the court may have a detrimental effect on human rights if the threat of prosecutions prevents lasting peace and the absence of peace leads to further violence and gross human rights violations.

This subject has generally been treated on the theoretical or philosophical level. Many suppositions are made by supporters of the court as to the deterrent value of international prosecutions, and by supporters of the “peace” side as to the detrimental effects of prosecutions on peace processes, yet little attempt has actually been made to test these propositions through the collection of empirical data. The project will assess the effects of the International Criminal Court (ICC) on conflict and peace processes through such a collection of empirical data. This will be done by way of field research into three selected case studies of situations/preliminary investigations before the Court. This will involve interviews with key stakeholders, focus groups of combatants, focus groups of civilians, civil society consultation events and surveys. In addition, comparative desk research will be conducted on the impacts of the ICC on conflict in the Court’s situation countries beyond the selected case studies.

The project aims to provide policy recommendations on transitional justice strategies to achieve both sustainable peace and accountability for gross human rights violations, as well as to provide policy relevant recommendations for the ICC on conflict sensitive approaches to outreach and prosecutorial strategy.
