Octopus conference on cybercrime: evidence in cyberspace, WHOIS data, cyberviolence, global state of legislation
Strasbourg 11-13 July
Ministers and other high-ranking government representatives, criminal justice experts, and representatives from the internet industry, civil society and data protection organisations from all over the world will participate in the conference which will open on Wednesday, 11 July at 2 p.m. (Assembly Chamber).
The conference will focus on solutions to strengthen the rule of law in cyberspace through a Protocol to the Budapest Convention. Consultations will be held with civil society, data protection experts and industry to review proposals for more effective ways to secure electronic evidence needed in criminal investigations, for example, through mutual legal assistance and direct cooperation with service providers. The Protocol is to be finalised by the end of 2019. A related topic is access to the WHOIS directory containing information on domain names.
Cyberviolence, the global state of cybercrime legislation and progress made through capacity building programmes will also be discussed.
Sixty countries are Parties to the Convention, another four have signed it and seven others have been invited to accede. Some 140 countries have made use of the Convention to design their domestic laws and over 160 countries have been cooperating with the Council of Europe to strengthen their ability to tackle the challenge of cybercrime.

In 2011 and 2012, several high profile campaigns spread with unexpected speed and potency. These "viral engagements” include the mobilization that scuttled the Stop Online Piracy Act, popular protest against the Susan G. Komen Foundation’s decision to stop funding Planned Parenthood, 100 million views of KONY 2012 video on YouTube and its subsequent criticism and defense, and on-line activism around the shooting of Trayvon Martin in Sanford, Florida. This paper examines three aspects of these viral campaigns as form of political engagement. First, is there a common structure of mobilization and spread? Some have argued that these viral campaigns synthesize conventional social and political networks but amplify the messages that spread through those networks through the speed of digital communication. Second, what are the potential contributions of this fast, cheap, and thin mode of engagement to democracy? We examine the implications of viral engagement for four critical democratic values: inclusion, public deliberation, political equality, and civic education.

Voter ID laws and a creaking Electoral College in the United States, street protests against a democratic deficit in Brussels, Rome and Athens, increasingly noisy praise for authoritarian capitalism in Singapore and Beijing / the contemporary political world is confronted with the nature and limits of democratic representation. The La Pietra Dialogues at NYU-Florence have recently regularly probed these issues, with distinguished scholars leading sessions on dissent, the euro crisis and the US elections. The Max Weber Programme at the EUI, meanwhile, is home to post-doctoral scholars from around the globe and across four disciplines. Their research this year is concerned with judicial independence, migrant labor rights, trans-national social movements and constitutional law, to name just a few areas that bear on the question of democratic representation.
This multi-disciplinary conference, co-sponsored by the La Pietra Dialogues and the Max Weber Programme, brings together invited senior scholars, Max Weber Fellows and the NYU-Florence community, in a joint La Pietra Dialogues-Max Weber Programme conversation. The conference will focus on how political and philosophical theories of democratic representation inform empirical social scientific research. For example, what can recent theories of global justice and democracy offer a political-scientist who researches Internet campaign fund-raising? What is a reasonable minimum condition for a government to be classified as 'democratic’ or 'representative’ of its citizens, and how can the social sciences help to answer this question with respect to any given state? Finally, how do such debates fit into contemporary political situations and scholarly practice?
These and other questions will be addressed via six panels, in each of which a senior invited guest and a Max Weber Fellow will give papers that enter into theoretical-empirical dialogue on a specific aspect of our broader rubric.

This workshop will be based on my forthcoming book of the same title. The study is an inquiry into the social, political, cultural and ethical aspects of the new surveillance (articles at www.garymarx.net are illustrative of my approach --several are listed below). The emphasis is on a conceptual framework dealing with structures, processes, cultural meanings and experiences that can accommodate and help explain the variation in surveillance tools --whether they involve video, biometry, sensors, RFID chips, GPS, social media and big data sets to mention only a few. My goals are normative, as well as social scientific, as I seek frameworks for judging and evaluating public policy.
I will of course draw examples from the policing of protest and law enforcement more broadly, but also from other areas such as work, consumption, school, government. I am also concerned with comparative international questions and the correlates and consequences of technological forms of surveillance which break traditional borders, as well as creating new ones

Many of the villas date from the Renaissance period and have been restored along with their landscaped gardens. Où en sommes-nous? se demandent les clients du V&D. L'atelier de la bonne gouvernance de l'Internet qui se retrouva au Conseil de l'Europe sur une idée très positive du Conseil National du Numérique (Axelle Lemaire et toute son équipe franco-canadienne) avec Jean-François Abramatic W3C/Inria et Valérie Peugeot d'Orange a défini les plus grandes lignes de la bonne gouvernance de l'Internet:
- Protection des familles de la bases, des enfants, des adolescents et de la jeunesse, des consommateurs affaiblis même dans les maisons de retraite
- Grands principes prioritaires et essentiels en lien avec les meilleures diplomaties
- Principes constitutionnels premiers: que disent les meilleures constitutions sur les questions essentielles?
- Normes, Standards et Brevets pour l'industrie électronique mondialisée vendue auX jeunes consommateurs et auX familles démunies
- Responsabilité des fabricants et des vendeurs et des douaniers
- TeXtes de loi sur les grandes questions liées au commerce mondial… avec des consommateurs vulnérables à la base
- Enquêtes judiciaires par la CPI de La Haye possibles
- L'immunité problématique du personnel de la fonction publique dans les institutions internationales
- Intégrité et honnêteté dans les postes à grandes responsabilités. Normal.

Alexander Seger has been with the Council of Europe (Strasbourg, France) since 1999. He is Head of the Cybercrime Division and in that function he is the Executive Secretary of the Cybercrime Convention Committee in Strasbourg as well as Head of the Cybercrime Programme Office of the Council of Europe in Bucharest, Romania.
Prior to this he headed for many years the Economic Crime Division where he was responsible for the Council of Europe’s cooperation programmes against cybercrime, corruption, organised crime and money laundering. From 1989 to 1998 he was with what now is the United Nations Office on Drugs and Crime in Vienna (Austria), Laos and Pakistan and a consultant for German Technical Cooperation (GTZ) in drug control matters. Alexander Seger is from Germany and holds a PhD in political science, law and social anthropology after studies in Heidelberg, Bordeaux and Bonn.

Comment penser tous ensemble la protection des enfants, des mineurs, des adolescents, de la jeunesse, des familles, des plus âgés devant leurs écrans, proies bien faciles pour les cybercriminels en tous genres?
Autre chose, à la direction des droits et devoirs de l'homme et de la femme, la réceptioniste au téléphone parle maintenant de la Charte sociale européenne. Où en sommes-nous? se demandent les parlementaires et les fonctionnaires européens un peu déboussolés. Ils appellent les gouvernements: en tout cas, les gouvernements français, allemand, néerlandais, luXembourgeois, belge et britannique pourquoi pas, mais les Scandinaves et les Italiens avec les Espagnols et les Portugais aussi. Et comme l'Europe est grande, il y a d'autres gouvernemens concernés. Qu'en pense-t-on en Autriche maintenant. Ils font quoi les Autrichiens en Europe? Même la Turquie et l'Afrique du Nord s'interrogent… en 2018.

L'Afrique du Sud et la Colombie se connectent... Qui fait quoi dans le Sud?...
Les Irlandais de Boston se connectent aussi. Les Irlandais restés au pays également. Le High-Tech du MIT se connecte peut-être aussi, la Silicon Valley appelle le MIT: qui fait quoi en Europe dans le High-Tech? GOOGLE y travaille avec ses contributeurs. Ils appellent Sophia-Antipolis du côté d'Antibes-Juan-les-Pins, l'Inria est au téléphone. Nos meilleurs chercheurs en sciences du numérique travaillent. Pendant qu'à la Pinède, les enfants jouent et que les mamies les regardent jouer… comme autrefois. Les Américains lisant cela se disent qu'ils pourraient bien revenir sur la Côte d'Azur: qui y fait quoi? BILL, Melinda&Kids ont décidé de descendre au Cap d'Antibes en vacances: se rapprocher de Sophia-Antipolis est une option pour Microsoft... avec GOOGLE. Et Texas Instrument dans toute cette histoire? Ou Alcaltel-Lucent. Nokia a décidé de commenter à Sophia-Antipolis... avec les plus gros actionnaires. British Telecom pourrait aussi se décider à participer auX meilleures rencontres conviviales du siècle à Mougins. James Bond OO7 participera aussi peut-être. En famille. AuX USA, même à Miami, les autorités commencent à se poser des questions: qui fait quoi dans la mondialisation des affaires? Quelle responsabilité sociale? SWIFT? Des parlementaires européens en ont parlé à BruXelles et Strasbourg: qui finance quoi? où sont allées les subventions? Les banquiers sont mis à contribution: quels dossiers reprendre? Même à LuXembourg. Les banques s'appellent. Internet parle encore de nous, diX ans après la crise de 2008. GOOGLE se connecte. Microsoft aussi. Même les ultra-libérauX et quelques lobbies financés par de(très) riches investisseurs. Tout cela est bien normal: où investir lorsque l'on a énormément d'argent? Des fonds de pension, même celui de Heerlen, la ville miracle, appellent maintenant les banquiers pour du bon conseil.

The Hague Summit for Accountability & Internet Democracy attracted high-level, interactive discourse among more than 200 senior policy makers, jurists and information technology professionals from 31 May to 1 June at The Hague Peace Palace.
Opened by the Deputy Prime Ministers of The Netherlands and Republic of Slovenia and the Mayor of the Hague, the inaugural Summit, on “An Internet of Values”, was organized by the Municipality of The Hague and the Institute for Accountability in the Digital Age, with the support of UNESCO and the International Telecommunications Union (ITU).
A number of speakers highlighted the appropriateness of The Hague as a venue for addressing the digital age. Deputy Prime Minister Kajsa Ollongren of the Netherlands recalled the role of The Hague and the scholar Hugo Grotius in defining the principles of Freedom of the Seas (Mare Liberum 1609), a set of the rules in favor of safe and open seas. “And now 400 years later, we have been asked to contribute on how accountability can be addressed over the Internet, and I think together we all hope that the result will be a safe and open Internet,” she said.
Deputy Prime Minister Boris Koprivnikar of the Republic of Slovenia underscored the value of “open as a public good and as a key to transparency and trust,” with the exception of personal, business and government data that must be protected.
Mayor Pauline Krikke of the Hague noted that social media is building bridges but also facilitating deeper social divides where “truth has become elastic.” She affirmed that the city of the Hague can play a role in the digital space through its “great deal of experience and concentration of knowledge as a unique place for international dialogue”.
In his keynote address, UNESCO Assistant Director-General for Communication and Information Moez Chakchouk urged for a multi-stakeholder approach based on the R.O.A.M principles for Internet Universality. The R.O.A.M. acronym stands for human Rights, Openness, Accessibility for all, and Multistakeholder participation and was endorsed by UNESCO’s 195 Member States in 2015 following a process of consultation with some 2,000 Internet stakeholders.
“Addressing accountability on the Internet depends on a commitment to the R.O.A.M. principles, supported by a robust focus on digital skills and Media and Information Literacy for every citizen we can reach,” Dr Chakchouk said, highlighting key programmes of UNESCO. “Media and Information Literacy empowers citizens to understand the functions of online information providers, to critically evaluate online content, and to make informed decisions as users and producers of information and media content online.”
Vint Cerf, chief Internet Evangelist at Google, called in a video message for a balanced approach that respects rights and freedom, where “the key is to train to think critically, how to reject false information and accept content of value”.
ITU Secretary-General Houlin Zhao spoke of the role of a trusted Internet in achieving the Sustainable Development Goals. “As we speak, more than half of the world’s population is not using the internet yet,” he said. According to the ITU Secretary-General, the common objective must be to provide access to all, regardless of age, wealth or disability as well as to ensure that Artificial Intelligence does not serve to deepen social biases and exclusion.
Mr. Indrajit Banerjee, Director of UNESCO’s Knowledge Societies Division, moderated two sessions at the Hague Summit. The first session consisted of a discussion on the concept of an “Internet of Values” and the basic principles that everyone could agree upon in order to ensure that we collectively build an Internet, which respects human rights and the rule of law. The second panel focused on the role that the media could play in ensuring accountability on the Internet.
The Hague Summit featured more than 30 invited presenters representing Members of Parliament, as well as media professionals, jurists, civil society, international organizations, educators and information technology representatives.
Speakers upheld multi-stakeholder modalities as a means to avoid disproportionate or unintended consequences of internet regulation, such as in a manner that directly violates legitimate criticisms of government policies.
“The goal of Internet governance is to engage all impacted stakeholders at all meaningful points of the discussion,” said Lynn Saint Amour, Chair of the United Nations Internet Governance Forum.
A number of speakers underscored that offline rights apply online as well, fundamental rules and values of society and international norms apply also in the digital age. One speaker noted that there is only one world, not an analog and digital one, no two sets of rules or ethics, but a need to adjust and align them.
Experts in Cybercrimes noted that the dark net is as much as 500 times larger than the surface Internet. It was reported that only a small fraction of reported Cybercrimes are followed up upon, with up to 96% of cases brought to the attention of authorities never prosecuted. Incitement to hate and terror serve to silence freedom of expression in some parts of the world.
Aimee van Wynsberghe, Director of the Foundation for Responsible Robotics, compared Internet accountability as an opportunity analogous to sustainable development, which was once seen as a potential constraint but now is viewed as a social necessity and business opportunity. “Accountability is the new sustainability” she suggested, as a disruptive business opportunity with the end goal of saving and sustaining the Internet.
