Questions fondamentales de la philosophie du droit

La philosophie du droit analyse les questions fondamentales relatives au droit comme par exemple:
Qu'est-ce que le droit ?
Qu'est-ce que le juste ?
Quel est le rapport entre droit et justice ?
Comment naissent les normes de droit ?
Quelles sont les techniques d'interprétation du droit ?
Quel est le fondement de la validité (de leur caractère normatif) du droit (voir le débat entre Hans Kelsen et Carl Schmitt, celui-là soutenant le « normativisme » et celui-ci le « décisionnisme ») ?
Quel est le rapport entre morale et droit (et notamment le débat sur les droits de l'homme et le rôle des valeurs éthiques par rapport au droit positif, c'est-à-dire aux lois et textes réglementaires existants) ?
